Eligibility and younger users

The website is intended for a general audience and is not directed to children under 13. If you are under the age of legal majority where you live, you may use the Services only with permission and supervision of a parent or legal guardian. Children under 13 must not submit forms, join the mailing list, or otherwise provide personal information through the Services without a parent or guardian.

Permission to use the website

Subject to these Terms, Ability Foundry gives you a limited, revocable, nonexclusive, nontransferable right to access and use the website for lawful personal, educational, charitable, or internal organizational purposes. This permission does not transfer ownership of any content or technology to you.

Acceptable use

You agree not to:

• use the Services in violation of law or another person's rights;
• interfere with, disable, damage, overburden, or disrupt the Services or another person's use of them;
• introduce malware, attempt unauthorized access, evade security controls, or probe the Services for vulnerabilities without written authorization;
• use automated means to scrape, harvest, or extract information in a manner that is abusive, deceptive, or materially burdensome;
• impersonate another person or misrepresent your affiliation;
• submit unlawful, threatening, infringing, deceptive, or harmful material, or personal information about another person without authority; or
• use Ability Foundry's name, trademarks, or content to imply an endorsement, partnership, or sponsorship that we have not approved in writing.

This section does not prohibit use of assistive technology, accessibility tools, standard search-engine indexing, or good-faith security research conducted under a written Ability Foundry policy or authorization.

Accessibility

Accessibility is central to our mission. If a feature, document, or process creates a barrier, please contact us. We welcome reports and will make reasonable efforts to provide an accessible alternative and improve the experience.

Ability Foundry content

Except for material subject to a separate open-source or third-party license, the Services and their text, graphics, logos, photographs, videos, design, and other content are owned by Ability Foundry or its licensors and are protected by intellectual-property laws. These Terms do not grant any right to use Ability Foundry's names, logos, or marks. You may link to public pages in a lawful way that does not imply our endorsement.

Messages and materials you send

You retain ownership of material you submit through the Services. You give Ability Foundry a nonexclusive, worldwide, royalty-free license to receive, store, reproduce, and use that material only as reasonably necessary to operate the Services, respond to you, and carry out the purpose for which you submitted it. You represent that you have the rights and permissions necessary to submit the material.

Please do not send confidential business information, unpublished inventions, medical records, or other highly sensitive material unless we have agreed in writing to receive it. A message to us does not by itself create a confidential, fiduciary, professional, or advisory relationship.

Feedback

If you voluntarily provide ideas or suggestions about our work, you permit us to use them without restriction or compensation. We are not required to use feedback, and we will handle personal information associated with it as described in our Privacy Policy.

Copyright concerns

If you believe material on the Services infringes your copyright, contact us at info@abilityfoundry.org with identification of the work, the allegedly infringing material and its location, your contact information, and a statement supporting your claim. We may request additional information needed to evaluate or process the notice under applicable law.

Disclaimer of warranties

To the fullest extent permitted by law, the Services and all content made available through them are provided “as is” and “as available.” Ability Foundry disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, accessibility, security, and uninterrupted or error-free operation. We do not warrant that information is complete or current or that the Services will meet every user's needs.

Limitation of liability

To the fullest extent permitted by law, Ability Foundry and its directors, officers, employees, volunteers, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, use, opportunity, goodwill, or profits, arising from or related to the Services, even if advised that such damages are possible.

To the fullest extent permitted by law, the total liability of those parties for all claims arising from or related to the Services will not exceed one hundred U.S. dollars (US $100) or the amount you paid Ability Foundry specifically for the Service giving rise to the claim during the twelve months before the event, whichever is greater.

Some jurisdictions do not allow certain warranty exclusions or limits on liability. In those jurisdictions, these provisions apply only to the extent permitted by law. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, or willful misconduct where applicable.

Governing law and courts

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Services that cannot be resolved informally will be brought exclusively in the state or federal courts located in Allegheny County, Pennsylvania, and each party consents to those courts' jurisdiction and venue. This provision does not prevent either party from seeking appropriate injunctive relief or bringing a claim in a court of competent jurisdiction where applicable law gives a nonwaivable right to do so.

Changes to these Terms

We may update these Terms as our Services or legal obligations change. We will post the revised Terms and update the “Last updated” date. If a change is material, we will provide additional notice when reasonable. Changes apply prospectively from their stated effective date. Your continued use of the Services after that date means you accept the revised Terms.

Miscellaneous

These Terms, the Privacy Policy, and any applicable additional terms are the entire agreement concerning the Services. If a provision is found unenforceable, it will be modified only as much as necessary and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization or transfer of the relevant program or assets. Headings are for convenience and do not affect interpretation.
